Legal issues: If the young man wants to sue whoever is responsible for this tragedy, he must claim that the occupier of that theatre was negligence; otherwise, he won’t get any compensation for the injury Special Negligence – occupier’s liability The occupier’s liability Act under [RSBC 1996] CHAPTER 337 states that someone considered being occupier if one of the following requirements is met: 1. Someone is in physical possession of the premises. 2. Someone is responsible for and has control over the condition of the premises. 3. Someone is responsible for and has control over the activities carried on at those premises. 4. Someone who has control over who is allowed to enter those premises. 5. Also, tenants and owners are both occupiers. In this situation, we have three different parties who consider being the occupier. 1. Leanne’s parents: As we know, Leanne’s parents are the legal owner of that theatre, consequently, they absolutely could be counted as one of the occupier, now, let’s examine if they were negligence at that time. (1) Duty of care: No matter what, as long as the invitees, licensees, trespassers are in the premises of the occupier; the duty of care automatically falls on the shoulder of the occupier. In this case, the question is: were Leanne’s parents careful enough to make sure the people in their premises were safe? Due to the fact that by the time the accident happened, her parents had already rent the whole theatre to Leanne by a proper contract, even though the renovation of that theatre wasn’t completed yet. Since the age of Leanne is not given, we could not tell if Leanne is over 18 or not. If Leanne is below the age of 18, According to the law, persons under the â€Å"age of majority†: 18 in Ontario (19 in B.C.) – at time contract made she would consider being a minor, and the law says that a minor usually cannot make a rational decision therefore treated as legal incapacity. In this case, the parents should be responsible for making their daughter the person who has control over the place. On the other hand, if Leanne is above 18, due to the fact that her parents have not warned about the possible hazards that the theatre could have to the visitors, they are still responsible for not fulfilling the duty of care. (2) Standard of care: As we know that the man with broken wrist was a trespasser who is not permitted before entering that premise (upstairs). The unfinished plumbing was not deliberately set up to harm any of the people at the theatre. Therefore, her parents have met the standard of care. (3) Physical causation: the unfinished plumbing was not the direct causation of that harm; nevertheless, it was the cause to make the water spilled and indirectly harm the young man. (4) Foreseeable harm: In this case, the harm is a bodily injury. Before this haunt, the theatre was in renovation, after Leanne proposed the haunted theatre plan; her parents accepted it and stopped the renovation instead. It is reasonable for her parents to notice that there should be some potential dangers in the theatre, however, they were just amazed by the idea and forgot about the foreseeable harms that could bring to the visitors. 3-step analysis: (1) Contributory negligence: Since there is a sign to warn the people that upstairs balcony is dangerous, even though they went to the bathroom instead of the balcony, they were still acting careless in a way that they ignored the sign. Plus, the reason for one of them to fall is because of the fact that they flushed the toilet with a unfinished plumbing, causing the water to spill, and made the floor wet, as a result, the man slipped and broke the wrist. Therefore, these two young man should share the liability for this accident. (2) Other defendant: Other defendants might be Leanne and also the contractor that is responsible for the renovation. (3) Vicarious liability: There is also no vicarious liability for this case. 2. Leanne: As a tenant who rent her parents theatre for one week, also the one that is responsible for and has control over the activities carried on at those premises, she is also consider being the occupier. For Leanne’s case, if she is below 18, then the contract between her and her parents are invalid, then she could not be sued. Otherwise she should be going through the following 4+3 negligence analysis as same as her parents. 4-Step Analysis: (1) Duty of care: As I have mentioned before, since the accident happened in haunted theatre was during the time Leanne rented from her parents, plus the activity on that night was under Leanne’s control, so that she automatically had the duty to make sure everyone is safe no matter the person is invitee, or trespasser. In fact, there were just so many visitors while there wasn’t enough staff to take care of the place, even though she had put a sign to warn the visitors not to go upstairs, but, there is still a possibility that somebody would ignore it and go ahead. On the other hand, the man’s wrist was broke right at the time when he fell, according to the relevant time says by the law, it again assures that the responsibilities would fall on Leanne. (2) Standard of care: As we know, after the contractor told Leanne about the plumbing problems she had set up a sign to warn the visitors to stop going forward. Normally if someone sees a sign tells them not to go forward, people would follow, however, during that evening the situation is slightly different. We know that it is a haunted theatre event during Halloween week; consequently the visitors on that evening are most likely to seek challenges and excitements. Therefore, it is reasonable for some risk loving people who would deliberately ignore the sign and go upstairs to seek for more fun. As the planner and the manager of the event, she should have studied the behavior of the potential customers in order to guarantee a better performance and strategies to control the whole activity. Nonetheless, the two young men were considered to be trespasser in this case due to the fact that the haunted event didn’t invite anyone to go upstairs. As a result, the duty owed to trespasser was extremely limited, according to the Common Law Status Approach, as long as the occupier of that particular premises didn’t mean to set up the hazard to trap the plaintiff, then, the standard of care will be satisfied by the occupier. (3) Physical causation: In this case, the wrist of the young man was broken in an indirect way. The plumbing of the toilet had some problems, after the young man flushed the toilet, it caused the water spilled out and the floor became wet. Finally, the young man slipped and broke his wrist. As we can see during the whole process, Leanne had done nothing directly or indirectly to cause the harm of the young man. However, it is the reckless conduct of the young man himself to cause the accident. (4) Foreseeable harm: As I have mentioned, before the haunted theatre, the theatre was in renovation. After Leanne proposed the idea of stopping the renovation for one week and opened the theatre for Halloween event, and the danger can clearly be foreseen. Even though the actual hazard didn’t harm the visitor directly, but it still created a dangerous situation for the two young men. 3-step analysis: (1) Contributory negligence: As I have analyzed in Leanne’s parents 3-step analysis, the plaintiff himself as a trespasser, ignored the sign to warn the dangerous situation of upstairs, and used the upstairs toilet which has a plumbing problem, as a result to make the water spilled on the ground and made the young man fell. Thereby, the young man had contributed to the accident, and should be sharing the responsibilities with whoever is negligence in this accident (2) Other defendants: Other than Leanne’s parents and Leanne herself, the contractor may also be responsible for this accident which I will be examined later. (3) Vicarious liability: There is no Vicarious liability in this case, since the actual harm brought to the young man was mainly caused by himself, therefore we couldn’t claimed that somebody hurt him while doing his/her job. 3. Contractor: The contractor is the one who is responsible for the renovation, naturally the condition of the whole theatre is somehow related to him and he should be responsible for that. As the occupier’s liability Act says that anyone that is responsible for and has control over the condition of the premises is considered as occupier. Due to the fact that the young man was hurt under the premises that was renovated by the contractor, he should consider being one of the potential defendant. 4-Step Analysis: (1) Duty of Care: As we know the contractor is one of the occupiers, therefore, he automatically has the duty to make sure the people are safe, no matter the people are invitees, licensees, or trespassers. (2) Standard of Care: As we know, before Leanne started her haunted theatre plan, the contractor had informed Leanne about the unfinished plumbing and the potential harm that could bring to the visitors. We could clearly tell that as an occupier, he did not try to harm the trespasser (Two young men) intentionally. Meanwhile, he actually tried to protect the visitors from being hurt. (3) Physical causation: As far as we know, even though the contractor is considered being an occupier, but, he didn’t have any control over the place at that particular day, moreover, he is not there by the time the accident happened. On the other hand, due to the fact that he didn’t finish the renovation and caused the plumbing problem and it lead to the water spill which ended up made the man fell down, this whole series of events are just too â€Å"remote†. In conclusion, there is not physical causation of this contractor to make the wounded man the way he is. (4) Foreseeable harm: As we concluded that the accident is just too â€Å"remote† from the contractor, therefore, there is no foreseeable harm caused by the contractor. 3-Step Analysis: (1) Contributory Negligence: As we have proven previously, the young man got into the premises where he was not invited to, thus, he considered being a trespasser. That is the reason for him to share the obligations of this accident. (2) Other defendants: There is no other defendant other than Leanne, Leanne’s parents, and the contractor. (3) Vicarious liability: There is no vicarious liability in this case. Legal Issue #2 Would two of her friends sue Leanne for breach of contract? Background: Leanne recruited two friends and offered them 20% of the net profit or a set amount of $500. Both of them indicated that they were sure 20% of the net profit would be work out to be more. After the operation of business, Leanne gave them each 20% of the net profit ($400) but those two friends asserted that the contract was for 20% of the net profit or $500 and they definitely would choose $500. Two of her friends would probably sue Leanne for breach of contract if Leanne paid them each only 20% of the net profit instead of $500. Let’s consider is there a contract between Leanne and two of her friends: Contract Requirements: â€Å"O+A+C+I† Offer: Leanne (offeror) offered verbally that she would give two of her friends (Offerees) 20% of the net profit or a set amount of $500. Consideration: Leanne (Offeror) would pay money to two of her friends (Offerees) while the offerees would work for Leanne. There is no gratuitous promise between them. Intention: Leanne had a need to recruit the workforce while two of her friends were passionate to work for Leanne, both of the parties showed their serious intention Hence, there was a contract existed between Leanne and two of her friends. Two of Leanne’s friends were able to sue Leanne for brea ch of contract. This contract could be viewed as either a unilateral contract or a bilateral contract. Reasons for a unilateral contract Two of her friends (Offerees) could accept simply by doing what offer required. They needed to work for Leanne and in return they would get money reward. Issue – Did Offerees have the right to claim an option at any time? The key term â€Å"20% of the net profit or a set amount of $500† would be the main argument for both parties in the court. Two of Leanne’s friends would insist that they had the right to choose an option at any time because Leanne had not made a deadline. Undoubtedly, there are different understandings of meaning in regard to this specific contract term. Both parties agreed on contract wording but the term meant different to them. In the eyes of two of her friends, the contract offered them two options that they could choose after they acknowledge the exact amount of the 20% of the net profit. With no doubt that they would go for the option which had higher amount of money. From Leanne’s perspective, she offered them those two options before they started to work. Leanne believed two of her friends accepted the term†20% of the net profit† by the fact that they said that 20% would work out better. In this situation, the court would apply the most â€Å"reasonable† interpretation to the key term: It was unreasonable that two of Leanne’s friends had the right to choose after they realize which option would be higher. Leanne’s offer would be meaningless if two of her friends could do so. The intention of offering an option of 20% of the net profit was to motivate two of her friends. The most reasonable interpretation would be that two of her friends only had the right to choose an option before they started to work, as a step to accept the Leanne’s offer. Therefore, their wording â€Å"20% would work out to be more† would be considered as approving this term only and accepted Leanne’s offer. Reasons for a bilateral contract This was a bilateral contract because offerees needed to trade promises with the offeror. The offerees’ wording â€Å"20% of the net profit would work out to be more† was strong evidence that they accepted this specific term so that they gave this promise to offeror they would work and in return they would get 20% of the net profit. Issue – was there breach of contract? As a matter of fact Leanne gave two offers to two of her friends, one offer with the key term â€Å"a set amount of $500† and another offer with the key term â€Å"20% of the net sale†. As two of her friends chose the second option, they rejected the first offer and accepted the second offer. In this case, two of her friends would not be able to sue Leanne because there was no breach of contract and the court would surely favor Leanne because she did not violate any terms on the contract. As a result, two of Leanne’s friends would not succeed in the lawsuit. In the future, Leanne should be more careful when she makes the contract. She has to list all key terms in details and elaborate on all those terms so that the offoerees would not have a different understanding on those terms. Legal issue #3 – Would the film maker sue Leanne for breach of contract? Background: The independent film maker would like to film in the haunted house and asked Leanne for the offer. Leanne asked for $500 and told the film maker that he could film any night that he liked. The film maker said he needed time to consider the offer. Afterwards, the film maker got very upset when he came to the theatre on Nov 5 and consequently realized that the haunted house was not in operation anymore and the renovation had resumed. Let’s consider is there a contract between Leanne and the film maker: Contract Requirements: â€Å"O+A+C+I† Offer: Leanne (offeror) offered the film maker (Offeree) that he could film on any night he liked and the price would be $500 Acceptance: After Leanne had offered to the film maker, the film maker said he would have to think about it so there was no acceptance at this point. But later the film maker came to the theatre to film on Nov 5 could be considered as an acceptance by conduct. Consideration: Leanne (Offeror) would provide the film maker (Offerees) a place to film while the film maker would pay Leanne $500. Intention: The film maker had a strong desire to film and Leanne was willing to provide the place Hence, there might be a contract or no contract existed between Leanne and the film maker, depends on whether or not there was acceptance and when the offer lapsed. Issue – when the offer lapsed? There was no specific time in the offer that required the offeree to accept. Thus the court would consider a â€Å"reasonable time†. The â€Å"reasonable† time was usually 1 month. Nonetheless, this â€Å"reasonable† time was difficult to tell in this situation. Leanne would consider the offer goes expire after Halloween, because the operation of the haunted house was a seasonal event and it was reasonable to presume that there would be no more people coming after Halloween. Leanne would likely shut down the haunted house after Halloween. From the film maker’s view, the â€Å"reasonable† time would probably be one month because this was usually a standard. It was reasonable for him to believe that the haunted house would continue to operate because he did not know Leanne only ran this event for one week. Thus, the â€Å"reasonable† time was hard to assess. If the court considered the â€Å"reasonable† time was before Halloween, then Leanne would be free from any legal liabilities. If the court insisted the â€Å"reasonable† time was within one month, then Leanne would be sued for breach of contract since she could not fulfill her promise. Leanne had to revoke the contract immediately before she stopped operating the haunted house to avoid any legal duties.

Techniques include bar and Gantt charts and network planning help with progress monitoring. Bar and Gantt charts define an uncomplicated view of activities aligned with timetables. Network planning is especially useful for complex projects because it links dependent activities in a logical order (Office of Government Commerce, 2003). The project sponsor must make an effort in order that final schedule to be simple and straightforward. The networks of activities of the final schedules, and the interrelationships between them should be sophisticated and comprehensive. They must be rapidly understood of the project sponsor that is why color-coded bar charts are used as management control documents (Office of Government Commerce, 2003). Schedule planning tasks The project manager must report on schedule planning to the project sponsor on behalf of the project team. The project manager must produce a work breakdown structure (WBS). WBS defines the work content of the project in terms of basic elements, work packages, generic tasks and detailed tasks (Office of Government Commerce, 2003). The main schedule planning must show how elements affect each other. It defines activities and also establishes the logical relationships of the activities. It determines the work content, the duration and the required resources of each activity. Furthermore, it also defines the critical path, which determines the duration of the project. Finally, it can optimize the time plan by resource leveling. Resource leveling compares the calculated requirements with those actually available and recalculates the network to spread resources more evenly (Office of Government Commerce, 2003). Progress monitoring Progress monitoring includes reviewing monthly progress reports produced by the project manager with others in the integrated project team (Office of Government Commerce, 2003). Progress monitoring must focus on critical activities and warn the SPOs attention in the proper time in order to appropriate actions to be taken as soon as possible. The project sponsor must understand the total rate of the whole progress in order to judge the forecast completion date. In order to measure the progress, the percentage completion of an activity can be measure in terms of cost and time. The planned progress must be compared with the actual progress. Also progress can be measure the work in progress by taking account of milestones of the project. Any impact on critical must be checked in order to finish the project on time. Furthermore progress can be monitored by the payment progress and from resources still required. (Office of Government Commerce, 2003). An essential element of process monitoring is the process of tome control. A time control system can cover time budget, time plan and time checking. Time budget represents the overall project duration as developed by specific constrains of the project in the contract strategy. It is the period which fixed one time and from that moment becomes one of the most important parameters for management of the project. Time plan is a division of total time into interlinked time allowances for identifiable activities, which can be defined start and finish points. Time checking is monitoring the time actually spent on each activity and compared it with the allowance in the time plan. If any divergence is identified, it must be reported as soon as possible. (Office of Government Commerce, 2003). In the case that an activity on the critical path exceeds its time allowance later activities must re-sequenced, or try to shorten the planned time for future critical activities by increasing the resources (extra cost) for the specific activities. If neither is possible to be done, the project will finish late. The project sponsor must understand that time control is as essential during the planning stages as the construction stages of the project. (Office of Government Commerce, 2003). Progress reports Progress reports are essential reports in the whole process of the project, because they keep the project sponsor informed about the project progress. They discover problems and choices for their resolution. Additionally, they provide the necessary information to enable the project sponsor to make decisions on time. Progress reports demonstrate that the integrated project team executes their responsibilities properly and that the management processes procedures and controls are operating successfully. They provide an authority, and a communication tool in a simple and comprehensive format, for the whole project team. Furthermore they provide a time reference for meetings and plans. In addition the gathering of statistics by the department permits external monitoring and identify best practice and support of improvement in performance. (Office of Government Commerce, 2003). Change control Change can be handled most successfully through project planning and control. Change for any reason must be treated as a project risk. Site investigations and conditions surveys must be undertaken early in the stages. The designs must adequately develop early in the project and definably before constructions plans are committed. Finally, a proactive project management in order to identify and managing risks will have as a result to minimize changes (Office of Government Commerce, 2003). A change control procedure must consider the factors, which will mention below, before approval is given for the change. It must taking account of the reasons for the change, and for its source, which is responsible for wanting the change. The consequences of the change in terms of quality, cost and time. It must consider the risks and their impacts associated with the change. In addition, alternatives to the proposed change must be evaluated properly. Suspense   Ã‚  Ã‚  Ã‚  Ã‚  I think the best example of suspense in Alfred Hitchcock’s films is Psycho. The suspense is built well through the music and the camera angles. I will choose the shower-stabbing scene to demonstrate all these elements, because the scene displays all these elements the best. The music fits the situations and events that take place. The playing of the screeching music when Norman Bates is in the process of stabbing Lila Crane in the shower, just the effect of the music makes this one of the most suspenseful scenes in movies history, at least in my opinion. Also, the camera angle builds the suspense. The angle of her screaming when the man opens the shower, then the cutting off to the knife and then the blood, displays the effects of the camera angles, and without even show the murder. The angle on the knife makes us perceive that she is being stabbed without even seeing it. And the blood makes us assume that she is dead, without even showing the body. He buil ds suspense without showing the specific details of a scene. Plot Twists   Ã‚  Ã‚  Ã‚  Ã‚  Hitchcock uses plot twists in his films to give the viewers the idea that something going on is happening, but in reality, it’s not. For example, in Psycho, Norman Bates’ mother really turners out to be Bates himself. And for Dial M for Murder, the key that was left on the stairs was used to help the detective catch Tony. The Trouble with Harry is that the whole time Harry has died of a heart attack, but we didn’t know that and all the other characters didn’t either. In Rope there really isn’t one. You could say that the two brothers killing David and putting him in that box could be a plot twist. An finally in Vertigo the lady really turning out to be someone else is a plot twist in the movie. CD for Holden Essay

How have you been? I have actually missed you a lot. The other day, I took a road trip with my parents and I thought of you. I remembered how you told me you wanted me to burn a CD with music for you. Thus, I listened to my iPod the whole way and selected many cool songs that I think you would like. Please get back to me and tell me which ones you liked and all. Also, I know you told me to only put around 10 songs but I could not contain myself and I chose 16 of them. I hope you will like them, because to tell you the truth all of these songs kill me. The first song I chose to put in the CD is â€Å"3 Cigarettes† by The Sleeping. Besides the beat and instruments that are cool as hell, the lyrics really remind me of you. First of all, there are the obvious connections to cigarettes, which seem to be one of your passions. Are you listening?† kills me and I am sure it will kill you too. It is calling for people’s attentions, it is calling all those phonies and it makes me wonder if anyone really cares about me. I am sure it will make you feel the same way too. The next song I chose was â€Å"Through the Glass† by Stone Sour. I think that this song is talking about an insider who became a stranger and now they are looking from the outside back in. This makes me think of you because many times throughout your life you have alienated yourself. You just look from the outside as time passes by and sometimes you feel like going back in, and being an insider again but you don’t. The phrase â€Å"I’m looking at you through the glass; don’t know how much time is passed. Oh God it feels like forever† makes me think of you a lot. Because you are always thinking about how quickly time passes by. It seems like you have been alienating yourself for a long time now, it feels like forever. The next song on your CD is â€Å"Tears in Heaven† by Eric Clapton. I just had to add this one. I know that you are really sensitive about your brother’s death and all, and you don’t like talking about it. However, I think that the sooner you face reality the better it will be for you and everyone. This song was made for his son who died. He was very meaningful to Eric Clapton just like your brother Allie was to you. I know you so well, that I am sure that you have wondered about many of the things that this song is stressing about. Such as if Allie would remember your name, and if it would all be the same. Also, there is a bigger picture to it. I remember about an specific conversation with your sister Phoebe you told me about. She asked you to name one thing you really liked and you said you really liked Allie. I think you should listen to lines such as â€Å"Cause I know I don’t belong here in heaven† and â€Å"Cause I know I just can’t stay here in heaven†. The bigger picture that these lines are showing and I am trying to prove to you is that as much as you love Allie you have to let him go. You are both in different worlds now, and wherever he is, you don’t belong there. At least not yet. Holden, you should really get on with your life and just keep with you all of the good memories you have with Allie but let him go. It is the best thing to do. I am sure you will enjoy quite a lot the next song I picked out for you. It is a classic by the great band Pink Floyd. This one is called â€Å"Another Brick in the Wall†. You might have heard of it already. The meaning of the song is to say that in school they treat us all the same and they do not respect that everyone is a separate and different individual. Pink Floyd is saying that this is all â€Å"false control† and they are putting all the students together and trying to make them all the same, therefore losing their individualities. I can tell that you will agree with these lines, and that they will really kill you. When they say â€Å"All in all it’s just another brick in the wall†, the meaning is that every single one of us students are just a tiny brick of the wall of hypocrisy, superficiality, and shallowness that they are trying to build. â€Å"They† are the ones that you every so often refer to as the â€Å"phonies†. That is what I think this song is criticizing, phonies who try to make everyone be the same. They try to make everyone be like them. Hopefully there are still people out there, like me and you, who are going to fight this and knock down this â€Å"wall of phonies†. The next song I picked is called â€Å"Boys Don’t Cry† by The Cure. It makes me think of you and Jane. When I listen to it, I think of how you like Jane so much and she is the only girl that you truly care about but you won’t tell her. Just like the song is describing, you often say â€Å"I would†¦Ã¢â‚¬  You mention things that you would do, such as give her a buzz, and visit her, and ask her on a date. However, you never do any of it. The line â€Å"boys don’t cry† is obviously making a critic to some boys like you, who would rather hide their feelings and appearing tough instead of telling the truth and possibly crying. I love the line â€Å"I try and laugh about it hiding the tears in my eyes† and the one â€Å"I try to laugh about it; cover it all up with lies†. Both of these lines are very strong. They also show things that you do. You often act all nonchalant and like giving Jane a buzz is just something you would do any d ay. However, I think it is much deeper than that. You are scared of being rejected by her because she is the only one you care about. So, you just act casual and cool about it and lie and hide your feels for her. The next song, â€Å"The Permanent Rain† by The Dangerous Summer follows the same line as the one before. I think that just like the singer is saying, â€Å"I won’t let this die†, you shouldn’t let what you have with Jane die. You and her both have a really strong connection and bond. I think it would be very sad if you did not do anything about it. I think you should go and tell her how you feel. It is really the best thing to do. When he says, â€Å"I know it’s not helping to hear me say: I wish it was me in the car the other day† really makes me think of you as well. Even though you have never actually told her about it, you have wondered for a long time about her and Stradlater in his teacher’s car. You wonder about what happened and you cannot help but wish that it were you with her in the car instead of Stradlater. Finally, when the line â€Å"You know it meant a lot, but I was just a kid† comes up it seems like it was wri tten for you. You were both too young to fully understand the connection that you both had. Now, I think you are old and mature enough to understand it and your relationship with Jane should mean even more if you tell her how you feel. The next song, however, is not about Jane. It is about High School, hence the name â€Å"High School Low† by Say Anything. Just like you, the guy in the song is sixteen. He is also worrying about things such as the whole high school experience, and girls. I find there is even a connection to you when he says, â€Å"My teacher says that I’m brilliant†. It reminds me of how Mr. Spencer would try and get the best out of you. He did not say you were brilliant, however, he acknowledge that you had so much more potential than the one you were showing with your poor grades and test scores. The passage about looking at pictures of himself when he was a child can also be compared to you. I know that you have often thought about how it is such a horrible experience having to grow up and all, but we will get to this topic later. To do with the whole grades issue, he also says â€Å"My grades look pretty damn low. I want to motivate myself, but how the hell am I supposed to work†. This is something that is so similar to you that it could have come out of your mouth. At the same time that you realize that your grades are low and you need to make an effort, you don’t know how to. You are confused about what you should do that would motivate yourself. I remember you told me that when your psychoanalyst asked you if you would apply yourself when you got back to school in September you said you did not know. I mean of course you want to, but as you said it yourself, you are not able to tell how you are going to behave. One phrase that is constantly repeated is â€Å"take me away†. Just like you, this boy wants to run away from these high school days and from all the â€Å"phoniness† and move on to a better part of life; be it the past or the future. Speaking of phonies, this is what my next chosen song is about. It is called â€Å"Mutiny!† by Set Your Goals. This song is clearly criticizing people. In my opinion, it is criticizing the phonies. What leads me to think this way is when things such as â€Å"superior, you are inferior† and â€Å"heroes have betrayed† are said. This is talking about people who think that they are better than other s when they really are nothing special. It is also talking about how people can just betray you and change all of the sudden. Finally, the line â€Å"I will find the line and cross it every time† reminds me of you. It reminds me of how you many times alienate yourself as a form of protection. Therefore, I think that crossing the line is a symbol for you of that crazy red hunting hat you wear. You wear it to prove your point and to show people that you don’t care and you’re fine with being different. This is nothing else but a way of â€Å"crossing t he line†. The next song I chose is called â€Å"Flake† and it is by Jack Johnson. In case you don’t know, a flake is someone who says that they will go somewhere or do something and then they don’t. Am I the only one who sees a resemblance here to you?! Yes, I am going to start talking about Jane again. You seriously have to stop saying that you will call her, unless you are actually planning on doing it. Otherwise, you are just flaking. The strong line â€Å"It seems to me that maybe pretty much always means no† is what I feel sometimes when you start talking to me about her. You say that you might call her if you feel like it. Now, I am starting to see it as something you just have to say to feel good about yourself, to show that you have the power to call her. I think you should not â€Å"flake† Jane. Besides that, it is a great song and I really love the instrumental and the beat for it. I am sure you will love it too! The next song I picked is a slow one. I find it truly beautiful. It is called â€Å"Cannonball† by Damien Rice. It is also a love song. What I think it is talking about is about someone whom he really loves but that he cannot be with for a reason or another. He talks about how he remembers the girl all the time, and the things that remind him of her. I think that the way he feels about this girl is just like how you feel about Jane. It reminds me of how you remember her because of little things such as how she always kept her kings on the back. This song also brings up the issue you have of lying and it claims that the issues he had to face in life when dealing with love are the ones that made him be like that. It also reminds me of you when he mentions that â€Å"It is not hard to fall when you float like a cannonball† because you can often be very â€Å"heavy† and therefore you sink into your issues like a cannonball sinking down in an ocean. My favorite like on this song, however, has to be the last one. It says â€Å"when you know that you just don’t know†. I think it is talking about when people are confused and how it takes courage, to even admit that you are lost. â€Å"Speed of Sound† by Coldplay is also sort of a slow song. The main point to this song is that it is talking about time. I think that Coldplay is trying to show how everything moves so fast, like the speed of sound. Time goes by too quickly, Holden. I know you have already realized that before, considering how you have told me countless times and made me notice that once we notice everything has already happened. This song could have been sung by someone who is waiting on a platform and they are noticing how fast things happen. It also talks about the issues we all have with dealing with this fast-moving time. Be prepared because this next song I am about to introduce to you will kill you. I am serious. It is called â€Å"Forever Young† and it is by Alphaville. It is impossible for me to listen to it and not think of you. The main point to this song is the fact that we all get old. The singer obviously wants to be â€Å"forever young† just like you! You tend to resist the natural process of maturity and growing up. It seems like you want to be forever young without having any responsibilities or having to deal with any problems of adulthood. I think this is mostly because you are scared. You are scared of what awaits for you, and it all sort of mystify you. That is why you invent that you do not want to be an adult because it is a world of phoniness. It is your way of running away from the fact that you are actually scared of growing up because you do not have a clue of what any of it is like. A line on this song that I find really interesting is â€Å"Some are like water, some are like the heat, some are a melody and some are the beat†. I think that this line is talking about the people that make our life what it is. The people that are there for us. I think that water is a symbol for the people that are a bit colder and the heat for the ones who are warm. The people who are a melody are the ones, like Jane, who come every once in a while and they completely change how you were before, just like the melody of a song. The â€Å"melodies† of someone’s life are not always there, but we can never be the same after they leave. Finally, the beat is a symbol for the people who are there to support you in your life constantly, just like the beat in a song. It is also impossible to be the same without the â€Å"beats† of our life, such as Phoebe, because they are the ones that we can call whenever we need. I think you will really enjoy the next song I picked. It is called â€Å"Marching Bands of Manhattan† by Death Cab for Cutie. First of all, the main reason of why it reminds me of you is the whole New York experience. I know how much that city describes you. I am sorry but I will have to bring old Jane up once again. I think that this song is mostly talking about how he wants to be with someone that doesn’t know how they feel. I think that this is your type of song, and I hope you will like it. When she was 19 she took the change to meet Erich Von Stroheim in hopes of playing cast in his film The Wedding March as Mitzi. The Major Events and Breakthroughs of the Nineteen Seventies Free Online Research Papers The nineteen seventies was a decade that experienced economic crisis, political struggle, feminism, and a rise of subcultures such as the hippies. These events reflected the rising power of baby boomers, which are babies who were born during the post WWII years, who have become adults and made up the majority of the population. Because of this, the decade became a reflection of baby boomers’ power that set the latest trends and influenced every aspect of the society. During the nineteen seventies, there were many events that took place. One major event that took place in 1973 was the oil crisis. It was caused by Arab members of OPEC (organization of the petroleum exporting countries) who announced that they would no longer ship petroleum to the United States and its allies in West Europe and that the price of oil would increase drastically. Because the U.S was now dependent on oil and the prices quadrupled the need for rations, our country went into a recession and suffered massive inflation. (People History par.1) This was a very stressful time for our country because the cost of living had highly increased in such a short amount of time. It was also a reason for prices increasing as much as they have in the present day. Not only did the oil crisis occur, but 1973 was also the year the United States withdrew from the Vietnam War. This was an important time for our country because it had been almost ten years that we had troops in Vietnam and ev eryone was eager to finally have peace again. Another significant factor of the nineteen seventies was the growth of feminism. Women gained the right to choose when, where, and if they wanted to have children. They gained this right through the famous case of Roe versus Wade, which centered around legalizing abortion (Drucker 77). Women also expanded their involvement in politics and even surpassed men in college enrollment in 1979 (American par.1). Because of this, not only did women become more independent, but this change in society led to higher divorce rates, causing some to go into poverty. So, it is easy to see that feminism in the nineteen seventies had both positive and negative effects on people’s lives. Included in the category of events are also scandals. Many people might remember, or know about, the Watergate scandal involving President Nixon. He and some of his supporters were part of a campaign that tried to tarnish the reputation of the Democratic Party, which included breaking in to the Watergate Hotel and tampering with official files. Of course, he tried to cover it up when it was discovered, but tapes were found of some of his â€Å"private† conversations with people involved and were ordered to be released. In mid-1974, he ended up resigning before he was impeached. (Watergate par.9-14) This is a good example of corruption in politics and how people will sometimes do anything to keep their power. I think that this event had a lasting effect on all the presidents after him and raised the standards for loyalty and honesty to the people. Finally, in the nineteen seventies was the beginning of a digital revolution. Companies now found ways to use technology which caused a drastic growth in smaller, powerful, and cheaper products such as calculators and televisions (People History par.2). Because of integrated circuits invented in the nineteen sixties and the invention of the home computer, companies were able to also invent products such as the first video game system, the Atari. Air travel also began booming due to the use of jumbo jets. (People History par.3) This became very useful because it helped to transport people overseas much faster and in larger quantities. Other inventions in the seventies include the following: floppy disks, barcodes, E-mail, genetic engineering, ink jet and laser printers, microprocessors, and MRI scanners. These inventions have been very useful to us in the twenty first century. Some are not used as much anymore, such as the floppy disk and the Atari, but they have served as the founda tion of newer, modern technology. Through many examples shown, I believe that I have proved that the nineteen seventies was a decade that was full of many significant and long lasting major events. It was also a time when many scientific, medical, and technological breakthroughs occurred. To give us a clear picture of the way the artist sees women, let us take a look at the lyrics of the song, the tempo of the music, the style, the phrasing and the tone. II. The Anatomy of the Song The song â€Å"Superman† is divided into three parts, namely the intro, the verses and the choruses. To put the song in context, the singer tells the listener about his experience with women and how his experience shaped his opinion about the female population. Although the singer did not really expound on what sad or bad experience he had with women, from the tone of his song, one can clearly see that this person does not trust the female specie and that he does not want to be in a serious relationship with any of them. The song starts with a woman’s voice moaning in the background and Eminem rapp ing in multisyllabic rhymes. Eminem rap along the beat of the drum as he delivers his lines in a rhythmic pattern. The voice of the woman moaning gives the intro of the song a sexual context which picture women as creatures who are meant to sexually satisfy the male. This personification of the female is rather disturbing as females are complex creatures and although they may have a sexual side to them, this sexual side does not define them as persons. Note that as complex creatures, women are capable of a lot of things and to box them in as sexually charged creatures moaning with pleasure is demeaning. The rhythm of the background music does not change much as the song graduate from the introduction and move into Chorus A. The voice of the singer goes with the beat of the drum as we move from the intro of the song to Chorus A and the woman moaning in the background fades away. In Chorus A, he describes how he might love the girl and how the girl might love him too so he comes to re scue the girl like superman does. If we take a closer look at the message of Chorus A, the singer implied that women cannot protect themselves and that they need men to save them. The song shows an even more blatant disregard of women’s potentials and capacities while trying to project men as the superior specie. Stereotyping women as â€Å"weak† creatures is not only grossly unfair, it is also demeaning especially when most women are actually more than capable of taking care of themselves. Verse 1 of the song pictures a woman as somebody who wants to trap the man in marriage. In an effort to get away from the grasp of the woman, the man tries to demean the woman by calling her a â€Å"slut† and saying â€Å"I would never let another chick bring me down.† The first few lines of Verse 1 are rather telling about the mental state of the man especially when he said â€Å"save it bitch, babysit†. Aside from fearing commitment, the singer seem to send a message to the listener that he sees women as homemakers who are only fit to do household chores and babysit. Asking a woman to babysit is not so bad but when you put babysitting in the wrong context, it can become quite offensive to the female sensibilities. Mark Antony, using persuasive techniques, managed to change the mindsets of the public who believed in the conspirators’ reason into believing that Caesar was a good man and had no bad intentions, which is what the conspirators thought. Mark Antony uses persuasive techniques like repetition, false intentions and sophistry. He uses these in his speech at Caesar’s burial to convince the crowd into believing his ideas by first commending Brutus on how honorable he is but then repeating how honorable he is to make the crowd question their faith in Brutus. He also says that he did not arrive to praise Caesar but to bury him which is exactly the opposite of what he wanted to do. Another false intention was that he did not want to disprove Brutus which is exactly what he did by using appropriate facts. Lastly, his speech was sophisticated and so led the crowd to believing that he was superior to Brutus which cemented his gaining the crowd’s support. In ‘Hullabaloo in the Guava Orchard’, the main character, Sampath, is a leader later on in the novel after losing his job at the post office where he reads every letter that passes him. He becomes a sort of spiritual leader as he passes on some of the knowledge, both useful and downright senseless, to those who believe he is one. He manages to convince the people who come to him for advice, as he seemingly has an answer that seems meaningful and wise, using persuasive techniques that include loaded language and glittering generalities. An example of the responses he gives to people is when someone asked him if anyone could comprehend all there is to know about god to which Sampath replied ‘‘ Once you have broken the bottle you can no longer distinguish the air inside from the air outside’’ This represents the colorful and loaded language Sampath represents as well as his ability to confuse and manipulate people into thinking meaningless sentences like these have greater meaning and that is the reason they cannot understand. He is also a leader because he represents a symbol of knowledge and religious importance and this gives people something to look forward to, believe in and rely upon. Queen Elizabeth the First was a leader as well when she ruled over England in 1588. She was brave, intelligent, caring and because of this, loved by the people. At this time, England was about to go to war with Spain. The units in concern were the naval fleets of both nations that were about to engage in combat. The Spanish fleet, nicknamed the Spanish Armada, were in comparison to the English fleet, bigger, stronger and heavily armored and this caused the soldiers to doubt their own ability to win and caused large bouts of cowardice. Despite this, the English fleet came out victorious. Queen Elizabeth, on the eve of the Spanish Armada, gave a powerful speech that motivated her soldiers and showed her love and respect for the country. Assessment of Plant Tissue Culture Plant tissue culture, the growth of plant cells outside an intact plant, is a technique essential in many areas of the plant sciences. Cultures of individual or groups of plant cells, and whole organs, contribute to understanding both fundamental and applied science. It relies on maintaining plant cells in aseptic conditions on a suitable nutrient medium. The culture can be sustained as a mass of undifferentiated cells for an extended period of time, or regenerated into whole plants.   Designing a strategy to culture cells from a plant for the first time can still seem like a matter of trial and error, and luck. However, the commercial production of valuable horticulture crops by micropropagation, which relies on tissue culture, shows that it exists in the routine, as well as experimental, world. In the School of Biological Sciences at the University of Liverpool, we have experience over many years with the techniques and applications of plant cell culture. What is Plant Tissue Culture? Plant cells can be grown in isolation from intact plants in tissue culture systems. The cells have the characteristics of callus cells, rather than other plant cell types. These are the cells that appear on cut surfaces when a plant is wounded and which gradually cover and seal the damaged area. Pieces of plant tissue will slowly divide and grow into a colourless mass of cells if they are kept in special conditions. These are: initiated from the most appropriate plant tissue for the particular plant variety presence of a high concentration of auxin and cytokinin growth regulators in the growth media a growth medium containing organic and inorganic compounds to sustain the cells aseptic conditions during culture to exclude competition from microorganisms The plant cells can grow on a solid surface as friable, pale-brown lumps (called callus), or as individual or small clusters of cells in a liquid medium called a suspension culture. These cells can be   maintained indefinitely provided they are sub-cultured regularly into fresh growth medium. Tissue culture cells generally lack the distinctive features of most plant cells. They have a small vacuole, lack chloroplasts and photosynthetic pathways and the structural or chemical features that distinguish so many cell types within the intact plant are absent. They are most similar to the undifferentiated cells found in meristematic regions which become fated to develop into each cell type as the plant grows. Tissue cultured cells can also be induced to re-differentiate into whole plants by alterations to the growth media. Plant tissue cultures can be initiated from almost any part of a plant. The physiological state of the plant does have an influence on its response to attempts to initiate tissue culture. The parent plant must be healthy and free from obvious signs of disease or decay. The source, termed explant, may be dictated by the reason for carrying out the tissue culture. Younger tissue contains a higher proportion of actively dividing cells and is more responsive to a callus initiation programme. The plants themselves must be actively growing, and not about to enter a period of dormancy.   The exact conditions required to initiate and sustain plant cells in culture, or to regenerate intact plants from cultured cells, are different for each plant species. Each variety of a species will often have a particular set of cultural requirements. Despite all the knowledge that has been obtained about plant tissue culture during the twentieth century, these conditions have to be identified for each variety through experimentation. Utilising anther culture to select for cold hardiness Crosses between distantly related species can bring together novel gene combinations. However, the hybrid offspring can be few in number, genetically unstable and require years of further selection and   screening before any advantageous characteristics can be brought near to commercial use. Anther culture (androgenesis), to generate haploid plants from pollen microspores, is one way to shorten this process. It allows novel allele combinations, particularly ones involving recessive characters, to be assessed in intact plants. Useful individuals can then be developed into homozygous and fertile plants through chromosome doubling techniques, and brought into a breeding programme. We have recently been involved in a collaborative project with the Institute of Grassland and Environmental Research (IGER) to use this approach to improve cold-tolerance and fodder quality in grazing grasses. Crosses between  Lolium multiflorum  ( Italian ryegrass) andFestuca arundinacea  (tall fescue) should offer valuable combinations of characteristics. TheLolium  species should provide good growth characteristics, while the  Festuca  provides stress-tolerance. One hybrid individual (Festulolium) resulting from such a cross had already shown drought-tolerance characteristics.   However, the out-breeding nature of these grass species, along with the hexaploid genome of  F. arundinacea  and autotetraploid  L. multiflorumindicated that a lengthy breeding programme might be necessary. The research project therefore aimed to produce androgenic plants from the existing pentaploidFestulolium  plant and assess them for cold tolerance. This exploited the expertise in tissue culture at the University of Liverpool together with experience in breeding for stress-tolerance at IGER. Anthers containing immature pollen (microspores) are the starting material for androgenesis. Flowers have to be selected at the correct developmental stage, which varies from species to species. In addition, some individual genotypes may not be amenable to anther culture, or require specific pretreatments. Careful microscopy and testing of successful pre-treatments of related species are therefore necessary when dealing with a new species. For the Graminae, microspores must be at the mononucleate stage and no pre-treatment is necessary.   The cut flowers were surface sterilised and opened in sterile conditions under a binocular microscope. The anthers were dissected and transferred to a solid nutrient medium. Large numbers could be placed on each petri dish. Callus developed, which was transferred to a different medium to initiate embryos and so generate haploid plants.   Over 200 androgenic plants were produced at Liverpool, each originating from a different microspore. Each therefore represented a genetically different individual. Testing for phosphoglucosisomerase, where a different isozyme was contributed by each of the five chromosome groups within the  Festulolium  plant, indicated that the pollen-derived plants had a wide variety of chromosome combinations from each of the parents of the hybrid. The freezing-tolerance of these plants varied considerably, with three individuals able to survive the extreme cold of -14 degrees Celsius. When the chromosome complement of two of these plants was examined using genomic  in situ  hybridisation (GISH), they carried virtually the whole genome of  F.   pratensis, a parent of  F. arundinacea  noted for its freezing-tolerance. Unfortunately, the fertility of these two plants was not restored by chromosome doubling, so that they could not be used for further breeding. However, they demonstrated the potential of androgenesis for rapid assessment of the genetic potential available from a difficult breeding combination, indicating that this type of wide cross revealed characters of cold and drought tolerance that were worth pursuing CASE STUDY  2 Using somaclonal variation to select for disease resistance plant tissue cultures isolated from even a single cell can show variation after repeated subculture. Distinct lines can be selected with their own particular morphology and physiology. It suggests that the tissue culture contains a population of genotypes whose proportion can be altered by imposing an appropriate selection pressure. This variation can be transmitted to plants regenerated from the tissue cultures, and is called somaclonal variation. It provides an additional source of novel variation for exploitation by plant breeders.   The carrot cultivar Fancy was used in our laboratory to generate a series of 197 regenerant progeny lines. These plants showed considerable morphological variation. They were tested for resistance to the leaf spot pathogen  Alternaria dauci, which can cause total necrosis of mature leaves. They had a greater degree of variation in response than the parental cultivar, including some more resistant lines.   Scanning electron micrographs of surface of carrot leaf 3 days after inoculation with A. dauci. (LHS) germination from multiseptate conidiospore (RHS) penetration of hyphae through epidermal surface rather than through stomata. Scale bar = 10 micrometres. One symptom of the disease is loss of chlorophyll and total soluble polyphenol compounds. These reduce to a low level 6 days after inoculation of excised leaves with  A. dauci  spores when compared with uninoculated leaves. Regenerant progeny with high chlorophyll levels maintained higher chlorophyll levels after challenge with  A. dauci.  After self-pollinating selected high- and low-chlorophyll regenerant plants, this characteristic was inherited by their progeny, suggesting that the capacity to resist this infection is inherited. CASE STUDY  3 Demonstration of tissue culture for teaching Initiating plantlets Regenerated African violets (Saintpaulia ionantha) Introduction The starting point for all tissue cultures is plant tissue, called an explant. It can be initiated from any part of a plant root, stem, petiole, leaf or flower although the success of any one of these varies between species. It is essential that the surface of the explant is sterilised to remove all microbial contamination. Plant cell division is slow compared to the growth of bacteria and fungi, and even minor contaminants will easily over-grow the plant tissue culture. The explant is then incubated on a sterile nutrient medium to initiate the tissue culture. The composition of the growth medium is designed to both sustain the plant cells, encourage cell division, and control development of either an undifferentiated cell mass, or particular plant organs.   The concentration of the growth regulators in the medium, namely auxin and cytokinin, seems to be the critical factor for determining whether a tissue culture is initiated, and how it subsequently develops.  The explant should initially form a callus, from which it is possible to generate multiple embryos and then shoots, forming the basis for plant regeneration and thus the technology of micropropagation. The first stage of tissue culture initiation is vital for information on what combination of media components will give a friable, fast-growing callus, or a green chlorophyllous callus, or embryo, root or shoot formation.   There is at present no way to predict the exact growth medium, and growth protocol, to generate a particular type of callus. These characteristics have to be determined through a carefully designed and observed experiment for each new plant species, and frequently also for each new variety of the species which is taken into tissue culture. The basis of the experiment will be media and protocols that give the desired effect in other plant species, and experience. The demonstration The strategy for designing a medium to initiate tissue culture, showing how growth regulators and other factors modulate development, can be demonstrated using the African Violet, a popular house plant. Leaf sections are the source of explants.  This demonstration is regularly carried out by a student class, and gives reliable results. Sterile supplies are provided from central facilities, and provision of sterile working areas (for example, in laminar flow hoods) is an advantage, although cultures can be initiated in an open laboratory with careful aseptic technique. The standard precautions used during any laboratory work involving chemicals or microbes should be adopted. If you are in any doubt about safety hazards associated with this demonstration, you should consult your local safety adviser.  Ã‚   Step 1 selection of the leaves Leaves are cut from healthy plants, leaving a short length of petiole attached. They should be selected to each yield several explants of leaf squares with approximately 1 cm sides. The youngest and oldest leaves should be avoided.   Wash the dust off the leaves in a beaker of distilled water, holding the leaf stalk with forceps. Step 2 surface sterilisation and preparation of the explants This part of the procedure should be carried out in a sterile working area, or with meticulous aseptic technique.   The leaf, with the petiole still attached, should be immersed in 70% ethanol for 30 seconds, then transferred to a sterile petri dish. Sterile scissors and forceps are then used to cut squares from the leaf as explants, each with approximately 1 cm sides. The explants are transferred into a 10% hypochlorite bleach solution for 5 minutes, gently agitating once or twice during this time. They are then washed free of bleach by immersing in four successive beakers of sterile distilled water, leaving them for 2-3 minutes in each. Three explants are placed on each petri dish of growth medium (see  table  and   below), with the upper epidermis pressed gently against the surface of the agar to make good contact.   The petri dishes are sealed with plastic film to prevent moisture loss, and incubated at 25oC in 16h light/8h dark. Step 3 assessment of tissue culture development The explants are incubated for 4 6 weeks, and inspected at weekly or fortnightly intervals. The growth of obvious bacterial or fungal colonies indicates contamination, and data from such cultures is obviously suspect. The development of dark brown tissue cultures can also be a consequence of contamination.   The media used in the demonstration are designed to show the effects of auxin, cytokinin, sucrose and mineral salts on development. The media were based on the well-known Murashige and Skoog inorganic medium, with additions as shown in this  table.   Typical results These  pictures  show typical results, after about 8 weeks on each medium. To summarise, multiple adventitious buds form on the  control  medium,   leading to many small shoots on the upper surface where the leaf is not in contact with the medium. Absence of  sucrose  inhibits this production. Shoot production is also limited on the low sucrose concentration, but comparable with the control at high sucrose. At zero and low levels of  cytokinin, callus forms where the leaf surface is in contact with the medium, while at high levels, shoot formation is stimulated. At zero and low levels of  auxins  there is a stimulus to shoot formation,   but at high concentrations, large numbers of roots are formed. At low and zero levels of  MS  salts, there is no growth at all. These very obvious variations demonstrate the importance of a carbon and inorganic salt source for plant growth, as well as the effect of the auxin:cytokinin ration on the control of plant development.
